Right To Property caused to be a Fundamental right by which Act & when?
A. 42nd Amendment Act 1976
B. 44th Amendment Act 1978
C. 49th Amendment Act 1984
D. 51st Amendment Act 1984
Choose the correct answer from the options given below:
Answer & explanation
Correct answer: option 2
The correct answer is Option (2) → B only
The right to property was a Fundamental Right under Article 19(1)(f) and Article 31. The 44th Amendment Act, 1978 removed both, so it ceased to be a Fundamental Right; it is now a constitutional (legal) right under Article 300A, which says no person shall be deprived of property except by authority of law.
A. 42nd Amendment Act 1976 Incorrect. It added the words “socialist” and “secular” to the Preamble and the Fundamental Duties; the right to property was untouched.
B. 44th Amendment Act 1978 Correct. It removed the right to property from the Fundamental Rights and added Article 300A.
C. 49th Amendment Act 1984 Incorrect. It brought the tribal areas of Tripura under the Sixth Schedule.
D. 51st Amendment Act 1984 Incorrect. It provided for reservation of seats for Scheduled Tribes in the Lok Sabha from Meghalaya, Arunachal Pradesh, Nagaland and Mizoram, and in the Assemblies of Meghalaya and Nagaland.
Note: It seems that there is a mistake in the original NTA paper, which prints “caused to be a Fundamental right” when it should read “ceased to be a Fundamental right”: no Act ever made property a Fundamental Right, while the 44th Amendment removed it from the Fundamental Rights. The question says “caused”, the Constitution says “ceased”; go with the Constitution.
