Explanation:

On 12 June 1975, Justice Jagmohan Lal Sinha of the Allahabad High Court passed a judgment declaring Indira Gandhi’s election to the Lok Sabha invalid. This order came on an election petition filed by Raj Narain, a socialist leader and a candidate who had contested against her in 1971. The petition challenged the election of Indira Gandhi on the ground that she had used the services of government servants in her election campaign.

The Parliament also brought in many new changes to the Constitution. In the background of the ruling of the Allahabad High Court in the Indira Gandhi case, an amendment was made declaring that elections of Prime Minister, President and Vice- President could not be challenged in the Court. The forty-second amendment (1976) was also passed during the Emergency. This amendment consisted of a series of changes in many parts of the Constitution. Among the various changes made by this amendment, one was that the duration of the legislatures in the country was extended from five to six years. This change was not only for the Emergency period, but was intended to be of a permanent nature.

Morarji Desai (1896-1995) was a prominent figure in the Indian freedom struggle, known for his dedication to Gandhian principles. He was a strong advocate of Khadi, naturopathy, and prohibition. Morarji Desai served as the Chief Minister of Bombay State and later as Deputy Prime Minister from 1967 to 1969. Notably, he made history by becoming the Prime Minister of India from 1977 to 1979, marking the first time a non-Congress party member held this position.

Fresh Lok Sabha elections were held in January 1980 in which the Janata Party suffered a comprehensive defeat, especially in north India where it had swept the polls in 1977. Congress party led by Indira Gandhi nearly repeated its great victory in 1971.It won 353 seats and came back to power.
